FTC proposes amending Negative Option Rule to include click-to-cancel and other protections

On March 23, 2023, the Federal Trade Commission (FTC) proposed changes to the cancellation policy for companies selling products or services under a “negative option feature”. This includes subscriptions, memberships, free trials that automatically convert to paid subscriptions, and other recurring payment programs that renew indefinitely unless the consumer takes action to cancel or return the goods or services.

California Arbitration Ban Ruled Invalid by Ninth Circuit Court

On February 15, 2023 the Ninth Circuit Court of Appeals struck down AB 51, a California bill designed to abolish employer-required arbitration agreements and seen by some as an indirect attack on the Federal Arbitration Act. Chamber of Commerce v. Bonta was pivotal in this decision.

DEA says THC-O is not Hemp & declares it illegal

On February 13th, 2023, The United States Drug Enforcement Administration (DEA) officially declared that any synthetic cannabinoids, including THC acetate ester or commonly known as ‘THC-O’, are prohibited under federal law since they do not naturally occur in hemp plants.
